Buyer Agreement

This Buyer Agreement (“Agreement”) governs use of the Oceanhood marketplace platform by buyers, vessel operators, seafarers, businesses, and customers (“Buyer,” “you,” or “your”).
By using the Platform, you agree to this Agreement.
MARKETPLACE ROLE
Oceanhood operates solely as a marketplace facilitator connecting independent buyers and sellers.
Unless expressly stated otherwise:
- Oceanhood is not the seller of products
- Oceanhood does not own inventory
- Oceanhood does not manufacture products
- Oceanhood is not responsible for product quality or merchant conduct
Transactions occur directly between Buyer and independent sellers.
BUYER RESPONSIBILITIES
Buyer agrees to:
- Provide accurate account information
- Maintain account security
- Comply with applicable laws
- Provide accurate shipping and vessel delivery information
- Pay all applicable fees and taxes
PRODUCT INFORMATION
Product descriptions, specifications, and availability are provided by independent sellers.
Oceanhood does not guarantee:
- Accuracy of listings
- Product suitability
- Merchant reliability
- Inventory availability
Buyers purchase products at their own discretion and risk.
INTERNATIONAL AND VESSEL DELIVERIES
Buyer acknowledges that maritime and international deliveries may involve:
- Customs delays
- Port restrictions
- Vessel schedule changes
- Security procedures
- Carrier disruptions
Oceanhood does not guarantee delivery timing or successful vessel delivery.
PAYMENTS
Payments may be processed through third-party payment providers including:
- Stripe
- Revolut Business
- Buyer authorizes applicable charges related to purchases, shipping, taxes, customs fees, and transaction fees
TAXES AND DUTIES
Buyer is responsible for:
- Customs duties
- VAT
- Import taxes
- Port fees
- Brokerage fees
- Local taxes
Certain maritime or export transactions may qualify for exemptions subject to applicable laws and supporting documentation.
RETURNS AND REFUNDS
Returns and refunds are governed by:
- Seller-specific policies
- Oceanhood Returns & Refunds Policy
- Applicable laws
Certain international or vessel-delivered orders may not be returnable.
PROHIBITED USE
Buyer shall not:
- Engage in fraud
- Use stolen payment methods
- Circumvent Platform protections
- Violate sanctions laws
- Misuse the Platform
- Engage in unlawful activity
SANCTIONS AND COMPLIANCE
Buyer certifies that:
- Buyer is not a sanctioned person or entity
- Buyer is not located in a prohibited jurisdiction
- Buyer complies with export and sanctions laws
Oceanhood may screen users and transactions for compliance purposes.
LIMITATION OF LIABILITY
To the maximum extent permitted by law, Oceanhood shall not be liable for:
- Product defects
- Shipping delays
- Vessel delivery failures
- Customs holds
- Merchant conduct
- Indirect or consequential damages
Oceanhood’s total liability shall not exceed the fees paid to Oceanhood for the relevant transaction.
DISPUTES
Disputes relating to products should first be directed to the seller.
Oceanhood may assist in mediation at its discretion but is not obligated to resolve disputes.
DISCLAIMER OF WARRANTIES
- The Platform and all Services are provided “AS IS” and “AS AVAILABLE.”
- Oceanhood disclaims all warranties to the maximum extent permitted by law
TERMINATION
Oceanhood may suspend or terminate Buyer accounts for:
- Fraud
- Chargeback abuse
- Compliance violations
- Breach of this Agreement
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Delaware, United States.
Any disputes shall be resolved exclusively in Delaware courts.
